Truck driver and trucking company sued for negligence

A jury trial has been requested in a case in which a man is suing a truck driver and the trucking company at which he is employed. The lawsuit stems from injuries the Tennessee man sustained after being involved in a truck accident in which he asserts the defendants were negligent.

The accident occurred while the plaintiff in the case was a passenger in a semi truck owned by his employer. Upon traveling along an Interstate, another tractor-trailer in front of the semi truck in which the plaintiff was a passenger crossed over into anther lane of traffic. Upon attempting to correct the driving error, the driver of that tractor-trailer truck lost control of the vehicle causing it to crash and turn over in the road.

The driver of the semi in which the plaintiff was a passenger was unable to avoid the overturned tractor-trailer and crashed into the vehicle. The plaintiff sustained multiple serious injuries as a result of the collision.

He has filed a lawsuit against both the truck driver and the driver's employer for negligence. Charges asserted in the lawsuit against the truck driver include failure to control the vehicle, operating a vehicle at excessive speed and failing to maintain the vehicle within proper lanes. Charges brought against the driver's employer include failure to employ a safe and competent driver, failure to properly train an employee as well as instruct and supervise the employee.

The plaintiff in the matter is seeking compensatory damages related to loss of wages, medical expenses, mental and physical pain as well as physical impairment and disfigurement.
